Agreement to Terms

By accessing digitalxrise.com or purchasing any DXR service, you agree to be bound by these Terms of Service. If you do not agree, please do not use our site or services.

Services

Digital X Rise provides website design, hosting, local SEO setup, lead capture tools, and marketing automation services for local service businesses. Specific services included in each package are described on our Services and Pricing pages. DXR reserves the right to modify or update service offerings with reasonable notice to active clients.

Payment and Billing

DXR services are billed on a monthly basis. Your billing cycle begins on the date your system goes live. Payments are processed automatically using the payment method on file. All fees are in US dollars.

If a payment fails, we will notify you and attempt to process the payment again. Services may be suspended after 7 days of non-payment and terminated after 30 days.

Cancellation Policy

Either party may cancel service with 30 days written notice. You will retain access to your service through the end of your current billing period. There are no cancellation fees or long-term contracts.

Upon cancellation, DXR will provide you with your website content and domain transfer assistance. Platform tools, automation workflows, and system configurations built within GHL remain the property of DXR.

Ownership

You own: Your business name, logo, photos, written content you provide, and your domain name.

DXR owns: The website build, design templates, system configurations, automation workflows, and platform environment built on our infrastructure.

Upon cancellation, we will export and provide your website content in a standard format. We do not hold your domain hostage — domain transfer assistance is included.

Client Responsibilities

To allow DXR to perform services effectively, you agree to:

Provide accurate business information, content, and materials in a timely manner
Respond to communications within a reasonable timeframe
Maintain accurate billing information
Use our services only for lawful business purposes
Not resell, sublicense, or transfer DXR services to third parties

Automated Communications

Rise package clients benefit from automated SMS and email follow-up tools. You are responsible for ensuring your use of these tools complies with applicable laws including the Telephone Consumer Protection Act (TCPA). DXR provides the platform and tools — you are responsible for the content and compliance of communications sent to your customers.

Limitation of Liability

DXR provides services on an “as is” basis. We do not guarantee specific results including search rankings, lead volume, or revenue outcomes. Our liability for any claim arising from our services is limited to the amount you paid in the 30 days prior to the claim.

DXR is not liable for indirect, incidental, or consequential damages including lost profits or business opportunities.

Uptime and Service Availability

DXR targets 99.9% uptime for hosted websites. Occasional downtime may occur due to maintenance, third-party platform issues, or circumstances beyond our control. We will communicate planned maintenance in advance where possible.

Termination by DXR

DXR reserves the right to suspend or terminate service immediately if a client violates these terms, engages in abusive behavior toward our team, or uses our services for unlawful purposes.

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States. Any disputes arising from these Terms shall be resolved in the courts of Virginia.

Changes to These Terms

We may update these Terms from time to time. Active clients will be notified of material changes with at least 14 days notice. Continued use of our services after that period constitutes acceptance of the updated terms.
